Arctic S.A. („Compania” sau „noi”), actionand in calitate de operator de date cu caracter personal, va folosi datele cu caracter personal pe care le colectam despre dumneavoastra in contextul unui proces de recrutare cu respectarea legilor aplicabile privind confidentialitatea si protectia datelor cu caracter personal. Daca aveti cunostinta de faptul ca au avut loc modificari sau ca exista inadvertente in legatura cu datele dumneavoastra cu caracter personal, trebuie sa informati Societatea despre respectivele modificari, astfel incat datele dumneavoastra cu caracter personal sa poata fi actualizate sau corectate.

Nicio candidatura si nicio participare la un interviu nu vor da nastere unei relatii de munca sau vreunui alt contract intre Societate si dumneavoastra. Depunerea CV-ului si a candidaturii dumneavoastra nu obliga Societatea sa aiba in vedere candidatura dumneavoastra, sa va acorde un interviu sau sa va faca o oferta de munca. Daca in urma unei candidaturi depuse de catre dumneavoastra Societatea va ofera un loc de munca, respectiva oferta de munca va fi conditionata de semnarea de catre dumneavoastra a termenilor si conditiilor scrise de angajare si de respectarea de catre dumneavoastra a oricaror alte solicitari rezonabile din partea Societatii.

 

 

Tipuri de Date cu Caracter Personal Colectate

 

Colectam datele dumneavoastra cu caracter personal atunci cand ne transmiteti CV-ul dumneavoastra sau cand candidati pentru un loc de munca prin intermediul unui formular de inregistrare online sau un website de cautare de locuri de munca ori atunci cand datele dumneavoastra cu caracter personal ne sunt transmise de terte entitati de recrutare. Datele cu caracter personal pe care le colectam si le folosim in legatura cu dumneavoastra constau in urmatoarele tipuri de date:

  • Informatii personale (cum sunt numele, titulatura, data nasterii, adresa, adresa de email, numarul de telefon, nationalitatea, genul, semnatura, locul nasterii);
  • Familia, stilul de viata si circumstantele sociale (spre exemplu starea civila);
  • Educatia si detaliile privind cursurile de calificare absolvite (istoricul studiilor absolvite); si
  • Istoricul locurilor de munca (inclusiv CV-ul si datele de contact ale persoanelor care va recomanda);
  • Rapoartele evaluarilor performantei, rezultatele interviurilor de evaluare a performantei, testele de evaluare a performantei, informatii despre activitatile intreprinse si cursurile absolvite pentru dezvoltarea profesionala, existenta permisului de conducere, calitatea de membru in diverse asociatii, calitatea de membru al unui sindicat sau al unei fundatii;
  • Este posibil ca unii dintre candidati sa furnizeze date cuprinse in cazierul judiciar sau cererile de cazier judiciar, desi astfel de date nu au fost solicitate; Societatea prelucreaza datele cuprinse in cazierul judiciar numai in conditiile speciale prevazute de lege, atunci cand prelucrarea este prevazuta de legea aplicabila (ca in cazul gestionarilor, posturilor din sfera activitatii juridice) sau cand este o conditie comerciala pentru unele posturi de conducere.
  • Alte informtii pe care ni le furnizati in mod voluntar (precum fotografia dumnavoastra).

 

 

Scopurile si Temeiul Juridic pentru Prelucrarea Datelor cu Caracter Personal

 

Datele cu caracter personal pe care le prelucram in legatura cu dumneavoastra vor fi folosite de Societate in scopul:

  • de a incheia un contract de munca cu dumneavoastra daca candidatura dumneavoastra este de succes, inclusiv in vederea activitatilor de administrare a personalului si pentru a desfasura verificari adecvate de securitate si privind istoricul dumneavoastra;
  • intereselor legitime ale Societatii in legatura cu administrarea, evaluarea si gestionarea candidaturii dumneavoastra pentru postul respectiv, inclusiv pentru a stabili daca corespundeti rolului pentru care ati aplicat si pentru a va informa in legatura cu evolutia candidaturii dumneavoastra; si
  • de a respecta obligatiile legale ale Societatii, cum ar fi prelucrarea de informatii despre nationalitatea dumneavoastra sau despre situatia vizei pentru a respecta legile privind imigratia si cele privind relatiile de munca;
  • activitatilor de practica si in vederea desfasurarii si implementarii unor proiecte legate de activitatea de practica.

 

Daca va opuneti colectarii si folosirii unora dintre datele cu caracter personal prelucrate in scopul indeplinirii obligatiilor legale ale Societatii sau in vederea incheierii contractului de munca, nu vom putea prelucra candidatura dumneavoastra.

Daca ne puneti la dispozitie datele cu caracter personal ale unor terte parti (cum sunt informatiile despre persoanele care va recomanda), trebuie sa va asigurati ca notificati respectiva terta persoana inainte de a ne comunica datele sale personale, prezentandu-i acesteia prezenta Nota de Informare, sa ii explicati faptul ca datele sale cu caracter personal vor fi prelucrate conform prezentei Note de Informare si sa ii obtineti acordul, acolo unde este cazul.

 

 

Verificarile Istoricului Dumneavoastra

 

Cu respectarea legii aplicabile, orice oferta de munca poate fi conditionata de finalizarea cu succes a oricaror verificari ale istoricului dumneavoastra, care ar putea consta in verificari ale datelor referitoare la referinte. Verificarile istoricului pot implica colectarea de informatii suplimentare in ceea ce va priveste de la institutii de invatamant, fosti angajatori, informatii aflate in domeniul public si agentii de aplicare a legii la nivel international, national sau local, in masura permisa de legea aplicabila.

Daca aplicati pentru anumite pozitii (precum pozitiile manageriale), daca acceptati o oferta de angajare sau daca sunteti angajat inainte de finalizarea verificarii istoricului, iar rezultatele verificarii sunt nesatisfacatoare pentru Societate, este posibil ca relatia dumneavoastra de munca sa inceteze, iar daca nu ati inceput munca, orice oferta de angajare poate fi retrasa sau orice contract de munca incheiat poate fi desfiintat imediat.

 

 

Dezvaluirea Datelor cu Caracter Personal

 

In scopurile indicate mai sus, este posibil sa dezvaluim datele dumneavoastra cu caracter personal unor alte persoane. Destinatarii datelor dumneavoastra cu caracter personal ar putea include:

  • Persoanele care va recomanda. In contextul (si in scopul) candidaturii dumneavoastra pentru un loc de munca in cadrul Societatii, vom contacta si discuta despre experienta si performanta dumneavoastra anterioare cu orice persoane pe care le indicati ca persoane de referinta. Acest lucru ar putea implica transferul unora dintre datele dumneavoastra cu caracter personal catre aceste persoane.
  • Alte entitati ale grupului international al Societatii. Este posibil sa transferam datele dumneavoastra cu caracter personal catre alte societati care apartin grupului Arcelik, inclusiv catre societatea mama Arcelik A.S. cu sediul in Turcia, care ar putea sa foloseasca datele dumneavoastra cu caracter personal conform prezentei Note de Informare. In special, in cazul in care candidati pentru o pozitie de nivel management - senior, datele dumneavoastra cu caracter personal vor fi dezvaluite societatii holding Koc Holding, care detine grupul Arҫelik, cu sediul in Turcia, care va fi cea care va lua deciziile finale de angajare pe astfel de pozitii.
  • Furnizorii de servicii. Societatea poate transfera datele dumneavoastra cu caracter personal catre societati care ne furnizeaza servicii si care actioneaza ca persoane imputernicite, cum ar fi furnizorii IT, in scopul dezvoltarii sistemului si pentru suport tehnic. Furnizorii de servicii sunt obligati sa pastreze confidentialitatea datelor dumneavoastra cu caracter personal si nu le este permis sa foloseasca datele cu caracter personal in niciun alt scop decat acela de a presta serviciile pe care ni le furnizeaza.
  • Partenerii de afaceri. Este posibil sa dezvaluim datele dumneavoastra cu caracter personal catre partenerii nostri de afaceri, daca acest lucru este necesar in cadrul procesului de selectie a candidatilor, cum ar fi agentiile online de recrutare (website-urile de recrutare) si societatile contractate pentru a desfasura verificarile istoricului dumneavoastra in numele nostru], centrul de evaluare, furnizorii de platforme de oferte de locuri de munca, agentiile de somaj.
  • Terte parti atunci cand este prevazut de lege. Este posibil sa dezvaluim datele dumneavoastra cu caracter personal catre o terta parte, daca acest lucru este necesar in vederea respectarii unei obligatii legale sau a unei decizii emise de o autoritate judiciara, o autoritate publica sau un organ guvernamental, ori daca dezvaluirea este necesara pentru asigurarea securitatii nationale, pentru aplicarea legii sau din alte motive de importanta publica.
  • Terte parti in legatura cu o vanzare de intreprindere. In cazul in care vom realiza o vanzare sau un transfer de active sau daca vom fi altfel implicati intr-o fuziune sau un transfer de activitate / active, este posibil sa va transferam datele dumneavoastra cu caracter personal catre una sau mai multe terte parti in cadrul respectivei tranzactii.
  • Alte terte parti cu acordul dumneavoastra. Este de asemenea posibil sa distribuim datele dumneavoastra cu caracter personal catre alte terte parti, cu acordul dumneavoastra. De asemenea, este posibil ca o terta parte sa ne puna la dispozitie datele dumneavoastra cu caracter personal, cum ar fi: CV-urile furnizate de sindicat sau de Universitate in scop de recrutare, etc.

 

 

Transferul International de Date cu Caracter Personal

 

Destinatarii datelor dumneavoastra cu caracter personal pot fi situati in tari din afara Spatiului Economic European („SEE”), Marea Britanie („Marea Britanie”) si Elvetia, care pot avea legi care reglementeaza un nivel diferit de protectie a datelor cu caracter personal fata de legile tarii dumneavoastra de resedinta. Ne angajam ca, in conformitate cu legile relevante privind protectia datelor cu caracter personal, sa protejam datele dumneavoastra cu caracter personal care ar putea face obiectul unui transfer transfrontalier.

Inainte de a transfera datele dumneavoastra cu caracter personal in afara SEE, a Marii Britanii sau a Elvetiei, vom adopta garantii pentru a ne asigura ca respectivele date beneficiaza de acelasi nivel de protectie ca si cel prevazut de legile aplicabile privind protectia datelor din cadrul SEE, Marea Britanie si Elvetia, inclusiv clauzele contractuale standard adoptate de Comisia Europeana. Puteti obtine un exemplar al acestor clauze contactandu-ne folosind informatiile din sectiunea „Date de Contact”.

 

 

Pastrarea Datelor Dumneavoastra cu Caracter Personal

 

Datele dumneavoastra cu caracter personal vor fi pastrate doar pe perioada de timp necesara in mod rezonabil pentru atingerea scopurilor prevazute in prezenta nota si pe termenul impus de legea aplicabila. In cazul in care candidatura dumneavoastra este respinsa, datele dumneavoastra cu caracter personal pot fi pastrate la dosar timp de 1 an  pentru procesul de recurutare si 2 ani pentru internship si pot fi folosite pentru oportunitati viitoare de angajare, sub conditia respectarii legii aplicabile privind pastrarea datelor cu caracter personal. In cazul in care nu doriti sa pastram datele dumneavoastra cu caracter personal in baza noastra de date de recrutare, va rugam sa ne comunicati acest lucru in cadrul candidaturii sau sa ne contactati folosind datele de contact din sectiunea „Date de Contact”.

Informatiile obtinute in contextul verificarilor istoricului vor fi pastrate doar pe perioada de timp necesara in mod rezonabil pentru atingerea scopurilor prevazute mai sus, in conformitate cu legea aplicabila.

Daca candidatura dumneavoastra este una de succes si va este oferit un loc de munca in cadrul Societatii, datele dumneavoastra cu caracter personal vor fi transferate intr-un dosar de personal si vor fi prelucrate si pastrate conform legii aplicabile si potrivit notei de informare adresate angajatilor, un exemplar al acesteia urmand sa va fie pus la dispozitie.

 

 

Drepturile Dumneavoastra

 

Sub rezerva conditionarilor si limitarilor prevazute de legea aplicabila, aveti dreptul de a solicita accesarea, rectificarea sau stergerea datelor dumneavoastra cu caracter personal sau restrictionarea prelucrarii acestora sau de a va opune prelucrarii de catre noi a datelor dumneavoastra cu caracter personal. Ati putea de asemenea sa solicitati portabilitatea datelor si sa contestati anumite decizii automate pe care le-am putea adopta in ceea ce va priveste, daca respectivele decizii au efecte juridice sau consecinte de o insemnatate similara. Noi nu desfasuram in general un astfel de proces decizional automatizat dar, in cazul in care vom intreprinde acest lucru, va vom comunica clar cazurile in care sunt luate astfel de decizii.

Solicitarile in acest sens trebuie depuse in scris folosind datele de contact din sectiunea „Date de Contact”.

Aveti de asemenea dreptul de a depune o plangere la autoritatea de supraveghere a protectiei datelor din tara dumneavoastra de resedinta.

Arctic S.A.  (“The Company” or “we” or “us”), acting under its capacity as controller of personal data, will use the personal data we collect about you in the context of a job application process in compliance with applicable privacy and data protection laws.  If you are aware of changes or inaccuracies in your personal data, you should inform the Company of such changes so that your personal data may be updated or corrected.

Any job application or the granting of an interview will not create an employment relationship or other agreement between the Company and yourself.  The submission of your resume and application does not obligate the Company in any way to consider your application, to grant an interview or to make an offer of employment.  If subsequent to a job application you are offered employment by the Company, that offer of employment will be conditional on your executing written terms and conditions of employment and complying with any other reasonable requests of the Company.

 

 

Types of Personal Data Collected

 

We may collect personal data relating to you when you submit your CV to us or apply for a job via an online registration form or a job-search website or if your personal data is submitted to us via third-parties, such as recruiters, referees, trade unions, universities or collected from general searches online.  The personal data we collect and use about you consists of the following types of data:

  • Personal details (such as name, title, date of birth, address, email address, phone number, nationality, gender, signature, place of birth);
  • Family, lifestyle and social circumstances (such as marital status);
  • Education and training details (such as education history);
  • Employment history (including CV and referee contacts);
  • Performance evaluation reports, results of performance evaluation interviews, performance evaluation tests, information on activities and trainings concerning career development, driving license, memberships of associations, foundations and trade union affiliation; and
  • It is possible for some of the candidates to provide data contained in the criminal record or the application forms of the criminal record, although such data have not been requested; the Company processes the data from the criminal record only in the specific legal conditions, when the processing is provided by the applicable law (such as: stock keeper, Legal positions), or as business requirement for some managerial roles; and
  • Any other information you provide to us on a voluntary basis (such as a photograph).   

 

 

Purposes and Legal Basis for Processing Personal Data

 

The personal data that we process relating to you will be used by the Company for the purpose of:

  • entering into an employment contract with you if your application is successful, including for purposes of personnel administration and to take steps which are necessary before the Company can enter into an employment contract with you, including to carry out appropriate background and security checks;
  • Company’s legitimate interests in connection with the administration, evaluation and management of your job application, including to determine your suitability for the role you have applied for and to keep you informed of your progress; and
  • meeting Company’s legal obligations, such as processing information about your nationality or visa status to comply with immigration and employment laws
  • internship and internship related projects and implementation.

 

If you oppose the collection and use of some of the personal data processed in order to meet  Company’s legal obligations or to enter into the employment contract, we may not be able to process your job application. 

If you provide us with the personal data of third parties (such as information relating to your referees), you must ensure that you notify the relevant third party before sharing their personal data with us by showing them this Privacy Notice, explaining that their personal data will be processed in accordance with this Privacy Notice, and obtaining their consent, where appropriate.

 

 

Background Checks

 

Subject to applicable law, the Company may perform background check for specific roles within the Company. In such cases, offers of employment may be conditional upon successful completion of any background checks such as reference checks.  The background checks may involve the collection of additional information about you from educational institutions, previous employers, information in the public domain and law enforcement agencies at the international, national or local level so far as is permitted by applicable law.

In case you apply for such a specific position (such as Managerial positions), if you accept an offer of employment, or if you are employed before the background checks are completed, and the results of your background checks are unsatisfactory to the Company, your employment may be terminated, or if you have not commenced employment, any employment offer may be rescinded or any employment contract entered into may be terminated immediately.

 

 

Sharing of Personal Data

 

For the purposes set out above, we may share your personal data with other parties.  The recipients of your personal data may include:

  • Referees.  In the context (and for the purposes) of your job application process with us, the Company will contact and discuss your previous experience and performance with any persons you indicated as referees.  This may involve the transfer of some of your personal data to these persons.
  • Other entities of Arҫelik’s worldwide group.  the Company may transfer your personal data to other Arҫelik departments and affiliated companies, who may use your personal data in accordance with this Privacy Notice.  In particular, if you are applying for a senior management-level position, your personal data will be shared with the holding company of the Arҫelik group, Koc Holding, located in Turkey who will make final hiring decisions for such positions.
  • Service providers.  the Company may transfer your personal data to companies that provide services to us that act as data processors in connection with the job application process, such as IT providers for the purposes of system development and technical support.  The service providers are required to keep your personal data confidential and are not permitted to use the personal data for any other purpose than to carry out the services they are performing for us.
  • Business partners.  We may disclose your personal data to our business partners if it is necessary for the job application process, such as recruitment agencies, companies contracted to carry out background checks on our behalf, assessment centers, job platforms providers, unemployment agencies.
  • Third parties where required by law.  We may disclose your personal data to a third party if it is necessary to comply with a legal obligation or the decision of a judicial authority, a public authority or a government body, or if disclosure is necessary for national security, law enforcement or other issues of important public interest.
  • Third parties in connection with a business sale.  If we make a sale or transfer of assets or are otherwise involved in a merger or business / asset transfer, we may transfer your personal data to one or more third parties as part of that transaction.
  • Other third parties with your consent.  We may also share your personal data with other third parties when you consent to such sharing.

 

 

International Transfers of Personal Data

 

The recipients of your personal data may be located in countries outside of the European Economic Area (the “EEA”), the United Kingdom (the “UK”) and Switzerland, which may have laws providing for a different level of data protection than the laws in your country of residence. In particular, we may transfer your personal data to our holding company located in Turkey.   The Company is committed, consistent with relevant data protection laws, to the protection of your personal data which may be transferred across borders.

Before transferring your personal data outside the EEA, the UK and Switzerland, we will adopt safeguards to ensure that such data will be afforded the same level of protection as under applicable data protection laws within the EEA, the UK and Switzerland, including the standard contractual clauses adopted by the European Commission, where appropriate.  You can obtain a copy of these clauses by contacting us via the information found in the “Contact Information” section.

 

 

Data Retention

 

Your personal data will be retained only for so long as reasonably necessary for the purposes set out in this notice and as long as required by applicable law.  In case your application is rejected your personal data may be retained on file for 1 year for recruitment application and 2 years for internship application to be used for future employment opportunities, subject to applicable law on retention of personal data.  If you do not want us to retain your personal data in our talent database, please let us know in your application or contact us through the contact details provided in the “Contact Information” section.

The information obtained in the context of background checks will be retained only for so long as reasonably necessary for the purposes set out above, in accordance with applicable law.

If your application is successful and you are offered an employment with the Company, your personal data will be transferred to an employee personnel file and will be processed and retained in accordance with applicable law and the applicable employee privacy notice, a copy of which will be provided to you.

 

 

Your Rights

 

Subject to the conditions and limitations set out in applicable law, you are entitled to request access to, rectification or erasure of your personal data or restriction of the processing or to object to the processing of your personal data by us.  You may also be able to request data portability and to contest certain automated decisions we may make about you if such decisions have legal or otherwise similarly-significant consequences.  Where the processing activity is based on your consent, you have the right to withdraw such consent at any time given, without affecting the legality of the personal data already processed. We do not typically carry out automated decision making but, if we do, we will make it clear where such decisions are being made.

You also have a right to lodge a complaint with the supervisory authority for data protection in your country of residence.
